1. Definitions
"We", "Us", "Our" refers to EAGLE EYE SNAGGING LIMITED, a company registered in England and Wales (Company No. 16465529).
"You", "Your" refers to the person or entity booking our services.
"Services" refers to the property inspection services we provide as described on our website.
"Report" refers to the written document we provide following the inspection.
"Property" refers to the building or premises to be inspected.
2. Service Description
2.1 We provide professional property inspection services for new build homes, including:
- New Build Snagging Inspections
- Pre-Completion Inspections
- Re-Snag Surveys
2.2 Our services include a visual inspection of the Property using professional equipment and expertise to identify defects, incomplete work, and non-compliance with building standards.
2.3 Our inspections are non-invasive. We do not:
- Move furniture or stored items
- Lift floor coverings
- Drill holes or damage surfaces
- Access areas that are unsafe or obstructed
- Test services under load or dismantle equipment
⚠️ Important Limitation
Our inspection is visual and non-invasive. We cannot guarantee to identify defects that are concealed, inaccessible, or latent. Our liability is limited as set out in Section 9.
3. Booking and Payment
3.1 Making a Booking
Bookings can be made through our website booking form or by contacting us directly. A booking is only confirmed upon receipt of the required deposit.
3.2 Payment Terms
- A 50% deposit is required to secure your booking
- The remaining 50% is due upon completion of the inspection and delivery of the Report
- All prices are total prices with no hidden fees
- Payment is accepted via Stripe (credit/debit cards, Apple Pay, Google Pay) or bank transfer
3.3 Late Payment
If the balance is not paid within 7 days of Report delivery, we reserve the right to charge interest on the outstanding amount at 8% above the Bank of England base rate.
4. Cancellation and Refund Policy

4.1 Cancellation by You
- 7+ days before inspection: Full refund of deposit
- 3-7 days before inspection: 50% refund of deposit
- Less than 3 days before: No refund, but one reschedule allowed within 30 days
4.2 Cancellation by Us
In the unlikely event we must cancel, we will:
- Offer alternative dates, or
- Provide a full refund if alternatives are not acceptable
- Compensate you for reasonable direct costs incurred due to our cancellation
4.3 No-Show Policy
If we are unable to access the Property at the scheduled time due to:
- No one being present to provide access
- The Property not being ready for inspection
- Incorrect address or contact details provided
The full fee will be charged and no refund will be given. We may offer to reschedule at our discretion, subject to additional charges.
5. Access and Property Conditions
5.1 Your Responsibilities
You must ensure:
- Safe access to all areas of the Property
- All utilities (electricity, water, gas) are connected and operational
- The Property is safe for our inspector to work in
- Any alarms are disarmed or we are provided with codes
- Parking is available within a reasonable distance
5.2 Dangerous Conditions
We reserve the right to refuse to inspect any area or item we deem unsafe. This will be noted in the Report.
6. Report Delivery
6.1 Delivery Time
We commit to delivering your Report within 48 hours of the inspection. Re-snag surveys are delivered within 24 hours.
6.2 Report Format
Reports are delivered digitally via email in PDF format. Printed copies are available upon request at an additional charge.
6.3 Report Content
The Report will include:
- A list of identified defects and issues
- Photographic evidence where relevant
- Categorisation of issues by severity
- References to applicable building standards
The Report is based on our professional opinion at the time of inspection and represents our best assessment based on visible evidence.
7. Your Rights as a Consumer
7.1 As a consumer, you have statutory rights under UK consumer protection legislation, including the Consumer Rights Act 2015. These terms do not affect your statutory rights.
7.2 Services must be:
- Provided with reasonable care and skill
- Completed within a reasonable time
- Provided at a reasonable price (if not agreed beforehand)
7.3 If we fail to meet these standards, you have the right to require us to repeat the service or, if that's not possible or timely, claim a price reduction up to 100% of the price paid.
8. Complaints
8.1 If you are dissatisfied with our service, please contact us as soon as possible at info@eagleeyesnagging.co.uk.
8.2 We will:
- Acknowledge your complaint within 2 business days
- Investigate thoroughly and respond within 10 business days
- Offer appropriate redress if we find in your favour
8.3 If we cannot resolve your complaint, you may be entitled to refer the matter to:
- The Property Ombudsman (if we become a member)
- Trading Standards
- The courts
9. Liability and Insurance
9.1 Professional Indemnity Insurance
We maintain professional indemnity insurance up to £1,000,000.
9.2 Limitation of Liability
Subject to Section 9.3, our total liability to you:
- For any claim shall not exceed the amount paid for the specific service giving rise to the claim
- For all claims in aggregate shall not exceed £10,000
9.3 Exceptions
Nothing in these terms limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any matter where liability cannot be limited under applicable law
9.4 Consequential Loss
We are not liable for any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of opportunity.
10. Data Protection
10.1 We process your personal data in accordance with our Privacy Policy and applicable data protection laws (UK GDPR and Data Protection Act 2018).
10.2 By booking our services, you consent to our processing of your personal data as described in the Privacy Policy.
10.3 We use Stripe for payment processing. Your payment data is handled in accordance with Stripe's privacy policy and PCI compliance standards.
11. Intellectual Property
11.1 The Report and all associated materials remain our intellectual property.
11.2 Upon full payment, you receive a licence to use the Report for its intended purpose (i.e., presenting to developers, warranty providers, etc.).
11.3 You may not:
- Sell or commercially exploit the Report
- Modify the Report without our written consent
- Represent the Report as having been prepared by anyone other than us
12. Third Party Rights
12.1 The Report is prepared for your exclusive use. No third party shall have any right to rely on the Report without our written consent.
12.2 We accept no liability to any third party who may come into possession of the Report.
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: severe weather, pandemic, government restrictions, or failure of utility services.
14. Governing Law and Jurisdiction
14.1 These terms are governed by the laws of England and Wales.
14.2 Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to Terms
15.1 We may update these terms from time to time. The current version will always be available on our website.
15.2 Bookings made before a change will be subject to the terms in force at the time of booking.
